Anthony Albanese under fire over key claim about released asylum seeker accused of bashing a pensioner in her home

Deputy Opposition leader Sussan Ley has slammed Anthony Albanese over a key claim about a newly released asylum seeker accused of bashing a grandmother.

Ms Ley unloaded on the Prime Minister on Sky News on Sunday as fallout continues over the alleged home invasion in Perth on April 16.

Ninette Simons, 73, and her husband Phillip, 76, were allegedly targetted by a trio that included 43-year-old Majid Jamshidi Doukoshkan - one of the 154 detainees released by the High Court. 

Outrage was sparked after it was revealed an ankle monitoring bracelet had been removed from the detainee prior to the alleged break-in. 

The Prime Minister said the decision was ultimately made by the Community Protection Board.

Revelations then emerged Jamshidi Doukoshkan was out on bail for previous offences with questions raised on why the Commonwealth did not oppose it.

The Albanese government claimed the protection board and the federal Director of Public Prosecutions were responsible for the matter.

Ms Ley has taken issue with the claim accusing Mr Albanese of trying to avoid accepting ownership for the massive bungle.

She said she was 'horrified and shocked and disgusted' by the whole ordeal.

'A 70-odd-year-old woman, cancer sufferer in Western Australia, (has) her face on the front of the WA paper,' she said. 

'The terror that she must have experienced and we've got a government that's just handballing it all to a community protection advisory board and even the Prime Minister suggesting that he's at arm's length.'  

She said immigration minister Andrew Giles has remained absent during the controversy despite calls for him and home affairs minister Clare O'Neil to be sacked.

'I think (Mr Giles) letting that get in the way of actually having a sensible, decent, human approach when you have the regulators and legislative tools to do something,' Ms Ley said.

Ms Simons on Thursday similarly demanded to know why the community protection board ordered for Jamshidi Doukoshkan's ankle monitoring bracelet to be removed weeks before she was allegedly attacked.

'How did he end up in our lounge room is what I can't fathom?' Ms Simons asked Mr Giles.

'I don't feel very safe here anymore, unfortunately, I don't, I'm doing my best to live here.'

Mr Albanese the following day said the board had made 'a wrong decision ... but they make the decisions'.

The Prime Minister said he wouldn't comment on 'operational matters' when questioned over the ankle monitoring issue.
