When a lifeguard was finally located, they were unable to help or touch Merino-Reyes and called an ambulance, as per the suit.

'Had defendant had lifeguards at the end of the ride to watch and help guests coming off the ride, plaintiff's brain injury would not have occurred as she wouldn't have been drowning in the water coughing up blood,' according to the suit.

It further stated that Typhoon Lagoon failed to keep the premises safe and did not warn her about dangers.
