Sean Diddy Combs asks judge to dismiss claim he and another man gang-raped 17 year-old girl at recording studio in 2003

Sean 'Diddy' Combs has requested the dismissal of a lawsuit in which he and another man are accused of gang-raping a 17-year old girl in a New York recording studio back in 2003.

He said the allegation was a 'false and hideous claim,' filed beyond the legal deadline.

This comes among several controversies the 54-year-old rapper and his legal team have been subjected to following several lawsuits and a criminal sex-trafficking investigation.

The filing reads:  'Mr. Combs and his companies categorically deny Plaintiff’s decades-old tale against them, which has caused incalculable damage to their reputations and business standing before any evidence has been presented

'Plaintiff cannot allege what day or time of year the alleged incident occurred, but miraculously remembers other salacious details, despite her alleged incapacitated condition.'

The documents of the lawsuit, which was filed in December and amended in March by the alleged female victim, named Combs-owned corporations as defendants. 

The woman, who chose to remain anonymous, said she was attending 11th grade in a Detroit suburb in 2003. She claimed music producer and president of Combs' Bad Boy Entertainment record label, Harve Pierre, flew her out to New York on a private jet.

The alleged victim claimed that she given alcohol and drugs to the point where she was incoherent and unable to have consensual sex.

She then said once under the influence, Pierre, Combs, and another man took turns raping her limp body. 

Photographs of the victim sitting on Combs's lap taken that were reportedly taken that night were submitted to the court.

The defense requested the case be dismissed 'with prejudice to protect the Combs Defendants from further reputational injury and before more party and judicial resources are squandered.' When a case is dismissed 'with prejudice,' it means the suit cannot be refiled.

“At this point, no one should take anything ‘Diddy’ or his lawyers say seriously,' the plaintiff's lawyer Michael J. Willemin said. 'Today’s motion is just a desperate attempt by Combs to avoid accountability for Ms. Doe’s allegations of gang rape and sexual assault. It won’t work.'

Under New York's Adult Survivors Act, victims of sexual assaults occurring before 2019 were given a three year 'lookback' period in which they were able to file lawsuits for abuse that occurred years or even decades ago, despite the three year statute of limitations, which has been extended to 20 years for crimes occurring after 2019.

Combs is the target of more than 3,700 lawsuits, some of which include allegations dating back decades. The new deadline has since expired.

However, Combs filed the motion against a suit that was brought under the New York City’s Victims of Gender-Motivated Violence Protection Law, which allows accusers to file civil suits even after the statute of limitations has passed.

Combs and his lawyers argue that the suit wasn't filed on time, and that the state law (New York's Adult Survivors Act) trumps the city's law (New York City’s Victims of Gender-Motivated Violence Protection Law) 'without exception.'

Although the modified version of the complaint, which was filed in March, attempted to address some of these difficulties, Combs' lawyers contend that it did not provide enough evidence.

If the lawsuit is to move forward, the judge said the woman's identity will have to be made public. 

Combs's legal team also argued that the use of 'a bolded, legally irrelevant ‘trigger warning’ calculated to focus attention on its salacious and depraved allegations.'

Combs has been the defendant in several sexual abuse lawsuits in recent months, all of which he and his attorneys have denied all allegations.

In a lawsuit Combs settled the day after it was filed in November, his former protégé and girlfriend, the R&B singer Cassie, sued him alleging years of sexual abuse, including rape. The lawsuit said he forced her to have sex with male prostitutes while he filmed them.

In February, a music producer filed a lawsuit alleging Combs coerced him to solicit prostitutes and pressured him to have sex with them.
