Judge throws out Jonathan Majors' bid to toss his criminal case meaning he faces sentencing after being convicted of assaulting ex-girlfriend

A judge has denied actor Jonathan Majors' request to set aside the guilty verdict in his domestic violence case.

The motion set forth by the 34-year-old's legal team was rejected Wednesday in New York, opening the doors to sentencing next week.

A jury found him guilty of reckless assault in the third degree and harassment, a misdemeanor and a violation, in December of last year.

Majors is set to be sentenced April 8 and faces up to one year behind bars.

The charges stem from a March 2023 incident in that began in the backseat of a chauffeured car in Manhattan's Chelsea neighborhood. 

According to prosecutors, Majors' then-girlfriend, Grace Jabbari, grabbed his phone after seeing a text she believed was from another woman, reading, 'Wish I was kissing you right now.'

As Majors attempted to get his phone back, he pulled Jabbari's finger, wrenched her arm behind her back and struck her face. 

The driver stopped the vehicle and Jabbari, a British dancer and choreographer, attempted to exit. However, Majors threw her back in.

Majors spent part of the night in a hotel but later returned home, prosecutors said.

There he found Jabbari, who said she fell asleep - but Majors insisted he thought she had fallen unconscious after attempting to commit suicide. 

The Marvel actor called 911, but when a dispatcher asked him to explain what had happened to Jabbari, he said, 'I don't know.' A recording of the call was released by the court.

Police arrested Majors on domestic abuse allegations but was released with a limited temporary restraining order.

The following day, the Manhattan District Attorney’s Office filed three counts of third-degree assault, one count of second-degree harassment, and one count of aggravated harassment against the actor.

Jabbari was granted a full restraining order on April 27, 2023 barring Majors from contacting her. 

In June of that year, Majors went to police with his own allegations against the choreographer, claiming she had been the aggressor.

Jabbari was arrested in October 2023, but the case against her was abruptly closed.

New York Criminal Court Judge Michael Gaffey later released evidence including the 911 call and photos depicting dark bruising on Jabbari's finger and a gash behind her ear.

Also among the exhibits were text messages between the pair. 'Maybe I'm such a monster and horrible man that I...should just kill myself,' Majors wrote hours after the altercation.

If Jabbari sought treatment for her fractured finger and other injuries, 'it could lead to an investigation,' he later wrote.

Jabbari promised to delay the visit, but insisted that she needed pain medication. 'I will tell the doctor I bumped my head,' she wrote.

The jury failed to reach a verdict on December 14, 2023. Four days later, Majors was found guilty, and a sentencing date was set for February 6.

But sentencing was deferred to April 8 after Majors' legal team asked Gaffey to void the conviction, filing what is known as a 330.30 motion.
