The Utah 'Karen' caught on video tormenting her interracial neighbors with slurs and pushing the stomach of a pregnant mom was charged with assault.
The family's lawyer said that they plan to file a civil lawsuit against Kathryn Smith, 67, who repeatedly berated them shortly after they moved to Midvale in 2019.
Marcus Stevenson, the Mayor of Midvale who has been involved in the case posted to X (formally known as Twitter) on Wednesday and said that Smith was taken into custody 'on her outstanding warrants.'
The warrant, which was shared with ABC News revealed that Smith was charged by the Unified Police Department with assault and was released on Wednesday.
'Imagine how it would feel to have somebody tell your children they were dogs or monkeys, you know, and then there's nothing you can do other than go talk to this woman who then is more ferocious with you,' Tyler Ayres, the family's lawyer said.

Authorities said they were called to the scene in June after the mother, who wishes to remain anonymous, reported that Smith came up to her children and started to yell at them.
The mother then confronted Smith about the incident, which was then recorded and has since gone viral on social media where she called the mother a fat a**' and the family 'n*****.'
The confrontation in one video begins as Smith sits in a lawn chair on her phone when the discouraged mother approaches her.
'Do not say s***. Please call the cops,' the mother says.
'Get off of my f****** property,' Smith replies.
'Do not talk to the kids,' the mother says.
Smith then gets out of her chair and forcibly points her finger in the mother's face. 'You keep your f****** dog on a f****** leash,' Smith yells.
The mother replies: 'Do not talk to my kids. C*** do you understand?'
'I don't even know if you have more than one kid, but you wanna know something? I don't talk to your kids so get the f*** out of my face,' Smith says.
'Do not say s*** to the f****** kids,' the angry mother says.
Smith then breaks into a dance and mocks the mother as she says: 'Oh, mama bear. I'm so afraid of you. I'm so afraid of you mama bear.'
'Just cause you f****** squirted a kid out of your c*** doesn't mean you're worthy of being a mother,' Smith says.
The mother then says 'touch me' before Smith says 'taunt me'.
'The kids can be outside and there is no f****** reason why you talk to them,' the mother continues.
'They're down by our house, they're not by your house. There's no f****** reason.'
Smith, who returns to her lawn chair then brings her cellphone to her ear before she quickly gets up and says: 'It's a free country. Get f******* out of my face.'

The mother then asks Smith: 'Is it a free f******* country? What are you gonna do?'
'Yes it is and your f****** fat a** is talking - get the f******* baby out of there,' Smith says as she touches the mothers pregnant baby.
The video shows Smith as she 'forcibly poked' and 'pushed with both hands' on the mother's pregnant stomach.
Other video showed Smith driving past the family's house as she screamed hateful comments at the family.
'I hear you got a nappy headed baby in there,' Smith can be heard saying to the mother as she walks her dog across the street.
In another clip Smith drove her car slowly past their house and said: 'Hey there n****.'
Tyler Ayres, the family's lawyer did tell Axios Salt Lake City that the family has 'lost work over it, and they've had to keep kids home from school because of it.'
'They're all in therapy over it, and so it's cost them significant money.'
Smith is seen mocking the mother as she said 'Oh, mama bear. I'm so afraid of you. I'm so afraid of you mama bear'
On separate occasions, Smith was also seen driving past the family's house as she shouted racial slurs and curse words at the parents and children

Ayres also revealed Smith started to torment the family shortly after they moved into the neighborhood in 2019.
Marcus Stevenson, the Mayor of Midvale posted about the encounter online and said: 'It's hard to describe how disgusted I feel learning that one of our Midvale families is living in a situation where they are dealing with regular racist tirades and feeling their safety is at risk.'
Ayres said that the family planned to meet with Stevenson on Tuesday to discuss the matter further.
DailyMail.com reached out to Stevenson but did not receive a response in time for this report.
Smith did not enter a plea deal, but is expected in court on January 11, Midvale Justice Court said.
'This woman has no sense. She has no filter, and she has no sense of right or wrong. She believes that she's entitled to do anything she wants, no matter how it affects everybody else. And she's learning that that's not the case,' Ayres said.
Smith could not be reached in time for this report.
